The Town of Day adopted The New York State Fire and Building Code in 1984 and later the Building Code of New York, which is the International Code. The Town also has a Zoning Ordinance, Subdivision Law and a Property Maintenance Law enforced by the Code Enforcement Officer.
The Town of Day was the first town in Saratoga County to become a land use town within the Adirondack Park Agency allowing land owners to obtain subdivisions and zoning variances in the Town of Day and not have to travel to Raybrook, New York as you would have to do if you did not adopt your own Land Use Law.
A building permit is required for all phases of building. The only time a permit is not required is if you are building a small accessory structure under 100 square feet (10’ x 10’8” x 12’). However, zoning still applies and must be 15’ off the property line and meet the setback for the zone you are located in.
