The Town of Day adopted The New York State Fire and Building Code in 1984 and later the Building Code of New York, which is the International Code. The Town also has a Zoning Ordinance, Subdivision Law and a Property Maintenance Law enforced by the Code Enforcement Officer.
The Town of Day was the first town in Saratoga County to become a land use town within the Adirondack Park Agency allowing land owners to obtain subdivisions and zoning variances in the Town of Day and not have to travel to Raybrook, New York as you would have to do if you did not adopt your own Land Use Law. A building permit is required for all phases of building. The only time a permit is not required is if you are building a small accessory structure under 100 square feet (10’ x 10'-8” x 12’). However, zoning still applies and the structure must be 15’ off the property line and meet the setback requirements for the zone that your property is located in. Please refer to Town of Day Zoning Law for further information.
Driveway Permits are required and need to be reviewed with the Town of Day Highway Superintendent: 518-696-3019, [email protected]
Stamped Plans by a New York State licensed Architect is required for projects costing $10,000.00 or more; and from a NYS licensed Engineer for projects with a cost of $20,000.00 or more.
Fences do not require a permit. Boundary/perimeter fences may be constructed within the setback area and not to exceed your property line. Fences shall not exceed six (6) feet in height.
DIG SAFE: CALL 811. Calling before you dig helps keep your family and community safe. Homeowners should contact New York 811, by dialing 811, at least 48 hours but no more than 10 working days (excluding weekends and legal holidays) before beginning any digging project.
